Q: Domestic Violance And Forced For Divorce

Am a victim of domestic violance and I was forced to do mutual consent divorce. When I refused my in husband and in laws took my phone and threaten me to either give divorce and take your phone or live without phone. Then I escaped because of again and again I was forced and physically assaulted and now I have heard through their relatives that they have proceeded for contested divorce.It has been happened 3 times that I have escaped with help of police and parents because of domestic violance. Now I have heard that they have filed for contested divorce.I still want to run my marriage successfully and want them to be compelled I don't want divorce and separation

You can seek mediation where a person will mediate the matter between the two and try to come to a settlement. This will help you either live with your husband or ease the separation process. Through mediation you will also get to know the reason why your husband is seeking Divorce. If your husband is not supporting you financially you can file for maintenance which will create financial strain on your husband. Most probably your husband wants a mutual divorce to avoid giving you any alimony or maintenance amount. It's your right to claim alimony and maintenance.

From the information you have provided nothing against you has been ordered by the Court. Since, you have not appeared before the Court, the petitioner i.e. your wife has been ordered to serve summons to you again within 7 days of the order so as to allow the Respondent i.e. the husband to file his reply. On the next hearing you need to appear before the Court and receive the copy of the petition filed.
