Questions Answered by Advocate Bharat Dixit

Q: Is chargesheet delay beneficial for accused

Respected seniors, My wife filled a false case u/s 498a, 504, 506, dp 3,4 and IT act 66 in January 2019. After investigation, the Mahila Thana issued Final report, however later she got re-investigation ordered. In the meantime I filled permanent injuction suit on the property I brought on joint name with her, that she falsely mentioned in her FIR as given by her father in dowry. The re-investigating officer was aware of the fact and pressurized me to settle by taking my cases back and going for MCD, however I insisted on apology letter from in-laws for filling false case, after which he went ahead with chargesheet on my name, removing other names from my family on 2 August 2019. The chargesheet has still not been filled in the court.1. Is this delay beneficial for me? 2. Is there a possibility that the complainant would have given a restatement to close the case?3. Is there a possibility for me to approach the High Court to get the FIR quashed, stating the delay in chargesheet?

Advocate Bharat Dixit answered
Yes, as per your submission it is v much clear that police personals and opposite party’s are playing some game . You should file a writ petition with annexing all documentation which are you having from beginning to end fir FIR quashing . Then you can get some conclusions either charge sheet is there or finl report. For more suggestions you can contact me up.Thnx

Q: Wife filed false dowry case will it come in background verification

Hi Sir, I am a hindu male. I have received a job offer from a very good MNC. My wife is going to file a false dowry 498A and DV case. I was called by Mediation Center for counseling. When I applied for job I mentioned "NO" for two questions"Have you ever convicted of a criminal offense" and has anyone ever filed/loged an FIR against you" I mentioned "NO" because there was no FIR at the time of filling application. I will be joining the company next week, and I am expecting an FIR against me. Will company expel me from employment because I mentioned "NO". The company will do background check and find out FIR which would be filed before one of week of joining date. Will they consider it fraud for providing misinformation in application? I was going through Mediation counseling while applying job, but that is not a legal FIR so I mentioned NO. Does 498A provide ground to a private company to terminal the job. Please help. Thanks

Advocate Bharat Dixit answered
Helo, after Persuing your query that there is no such kind of act has been done by you that company will expel you. It’s a matrimonial case and family disputes ,you are not a habitual criminal and not not convicted till now. So they hav no right to take any action against you if the FIR has not been ragisterd at the time of filling the company’s form. There are many way to safe your side. For more information contact me.Thnx

Q: Fake certificate submitted and expelled what to do

Hi I m working with a company for 2 years , I altered my previous employer relieving letter to get hike in salary , though HR in my current company was aware with the fact that I altered the experience, even every third person in my company has done so as our company is in need of experienced candidates, I had a personal argument with the HR last week regarding leaves, he called me up and expelled me and threating me that he is going to complaint against me for forgery. I am confused what to do now? Every one in the company has submitted fake experience letter but he only expelled me. Please suggest? What can I do next if he lodge a complaint against me.

Advocate Bharat Dixit answered
Helo, that the certificate of experience has been submitted by you to the company was forged and company expelled you.as par your information that you are working with the company last two years and it is company’s responsebility to verify all documents , which has been submitted by you at the time of the joining . Documents are fake or real? Now do them what ever they want and move a letter to concerned authorities that the company is doing harresment last one month , when I opposed them, they are doing much harresment using many illegal ways. For more information contact me. Thnx
