you can contest the matter by virtue of being a tenant and in possession of that house which has received the notice from the Nagar Nigam you should Ideally respond to the said notice to Nagar Nigam informing them that the house is not in a condition where it cannot be used any more and also about the renovations that have happened in 50 years and then you can move the civil court for relief and seek stay on demolition
Q: Naksha change In My Father and his brothers property during bandobast
My father and his brother seprated 27 years ago, at the time of sepration a partion deed was signed on local paper (including 3 witness 2 died). The same partion deed after 2 years finalized on stamp paper of 50 RS (without notary and registration) (signed by both brother and two witness both alive).for 27 year we have kabza as per partion deed but during bandobast around (20 years back) my Uncle micheaviously make patwari to partion the naksha so that half of his rakba can come in my fathers land. Now recently when my father started some construction on his land. Uncle filed complaint to SDM against CRPC 145.We have 5-10 village people and relatives who can be witness to say that for 7 years we have kabza as per partion agreement. We tried negotiating with uncle but he is not agreeing even for inch of land.what we should do now??
Advocate Shantanoo Saxena answered
This matter pertains to the batan of the property what needs to be seen is that after the first partition or second partition if any case was filed for officially recording the same and if such official action was done prior to bandobast. Then its essential to check bandobast records and their basis. Then based upon the data you need to stake your claim on the property. If your name is on the Khasra and it's agricultural land then even a demarcation application can solve your purpose, all depends on the factual scenario.

Q: Land agreement dispute between 2 parties and owner
Hello, I'm from India, and the situation is that I want to buy a 2400sq ft plot of land near my house, but the owner (who wants to sell it to me) already has an agreement and notary with another party for Rs.7 lakh token only, but the date of the agreement has passed, and the owner can return him the money even with interest, but that party refuses to end it (really, that party doesn't want me to take that plot), so after the agreement expire , will that party interfere in the registry?, and could they use that agreement to take this matter to court?
Advocate Shantanoo Saxena answered
The party which has the agreement chances are of them taking it to court, after he sells to you or does agreement with you. You need to ask the owner to give this other purchaser with whom he has an agreement a notice informing him about the cancelation of agreement, but this is subject to the terms of the agreement and to publish a notice stating that he is free to sell it to anybody, if he objects then the matter needs to be taken to court to get the earlier agreement nullified.
