Questions Answered by Advocate Sanket Singh (25+ answers)
Q: Theft my name has been given has witness
My name has been given has witness without my consent need advise as been called out for hearing
Advocate Sanket Singh answered
Your name would only get inserted in list of witnesses if you had given a statement to the police during investigation. In the event you have received summons to witness from court you will have to go for the same. You can ask for reasonable compensation for your time though. Best course of action would be to go to court on the date specified and cooperate. If you do not want to give evidence then you can refuse in court by saying you were made a witness without consent or being informed. Alternatively you can say you know nothing about the matter.
Q: Amended copy in court with amendment application without order
Hello friends,Yesterday, in one of my cases in Mumbai, I filed an application seeking leave to amend the criminal complaint. Judge asked me to submit the amended copy of complaint with amendment application. I filed the copy assuming he will pass order, but didn't.However, on the amended copy i filed, i have mentioned (typed) that "amended on 31.08.24 as per order dated 31.08.24". Now since amendment was not allowed yesterday on 31.08.24, Can there be any consequences? What can I do?
Advocate Sanket Singh answered
The amendment procedure involves filing an application with draft amendments and posting for hearing. After hearing arguments, the judge issues an order approving or rejecting the application. Since you typed incorrectly in the draft amendments, inform the court and provide a fresh draft amended complaint on the next date. The judge may allow you to replace the document or tell you to withdraw the application and file again. Though the error is minor and likely inconsequential if corrected promptly, failing to rectify it may lead to allegations of misrepresentation and contempt of court, resulting in potential punishment.
Q: My dob related issue pls help me find a solution
Hello sir/ ma'amI am from navimumbai, I wanted your expert advice on a legal matter..the thing is my dobprinted on aadhar card is wrong..my actual year is 1996 but in aadhar its 1986...I didn't get it corrected at that point of time..but recently I've lost some of my imp docs in an accident so can't change it with help of supporting docs ..if I present a fakeb certificate just to correct my dob in aadhar would I have to face legal actions even if I donot misuse my adhar card fr any wrong purpos
Advocate Sanket Singh answered
Yes. Providing fabricated documents for adhaar will be a serious criminal offence and one which can very easily be detected by the authorities while verifying the said documents. It is advisable to have your birth certificate or other records reissued and use authentic documents for the purpose of updating adhaar details. The process of having these documents reissued is not very complicated or difficult. Please keep in mind that using fabricated documents may give rise to unwanted suspicion from the authorities and lead to adverse consequences. It is always better to be safe than sorry.
Q: Received Passport show cause notice after receiving passport
I had applied for my minor sons passport and alresdy got passport but address which I gave was my permanent address which went in redevelopement and I'm staying in very next building in flat which is also in my name. Unfortunately for minor got police verification, the police knows me and where I stay I met him also but he gave adverse report stating building in redevelopemy and not found there. I got show cause notice after 2 months asking to explain the same. If you can please help
Advocate Sanket Singh answered
You can reply to the Show-Cause Notice explaining the situation and providing the address where you reside presently. Please note that if certain legal consequences are threatened in the Show Cause Notice it would be better to have a lawyer prepare and reply to the Show-Cause Notice since a layman would not understand the provisions of law involved.
Q: How many days it will take for bail after filling of chargesheet
My husband is a distributor of medicine he purchased medicines from some company and supplied to another whole sale distributor later on it was sent for some sample testing and then my husband came to know that medicine is not containing any content. Fir is lodged against all the three including my husband. Rt now my husband is in jail from last two months.what to do ?
Advocate Sanket Singh answered
You will have to file an application for bail. The allegation of selling fake / adulterated medicine is serious in nature and the case will heavily depend on what evidence the prosecution has obtained as against your husband. In any event pending trial of the case it is possible to obtain bail on certain conditions which the court may impose. As an undertrial your husband has a right to apply for bail during the pendency of the case. Proper advice can only be given on seeing the exact nature of charges framed against your husband and the evidence of prosecution.
