Q: I will sell the property but cheques by buyer will bounce, what to do?

Me and mom will sell the property but that person give pdf checks and they will be bounce so i will cancelld the regisry or sellded property so what can be possible sir

You and your property may be at risk if you accept post dated cheques from buyer. In a sale transaction it is necessary that you receive entire consideration amount. Sale deed without consideration is not valid. So ensure that the buyer pays you full amount before you sell the flat.



Q: Daughters right on fathers property without his will

Can any daughter claim on her father's property against her father's will? means that if any father don't want to give property to her daughter and only wants to give his property to his son,then the daughter of that person can claim on her property right or not.or will of father is necessary?please explain in deep if possible.

A person can deal with his self acquired property as he wants. If he keeps his last WILL, the beneficiaries of the WILL are entitled to the property unless the will is proved to be made by fraud or undue influence. However if he dies without making a WILL then his legal heirs have right and are entitled to his property.



Q: Compensation along with interest for delay in possession by builder

I had purchased a flat and signed an agreement in 2011, wherein the possession date is 30 Sep'14. However, till date I have not got possession. Hence, I have registered a compliant at MAHARERA against builder for delay in possession by more than 3years. I ask asked for compensation in the form of interest for delay of possession under section 18 of RERA act. I would like to know if we can claim interest from builder although the agreement is signed in 2011. If Not, will I get justice in consumer court?

Yes. You can claim interest from the builder. The clauses of your agreement needs to be checked in detail. MAHARERA is an additional remedy for you. You can also approach consumer court or can file suit in civil court for specific performance of contract and possession.



Q: How to register mothers varas hakka after winning appeal.

Appeal won us and as per prant result its been declared to make equal proprty hissa. please guide how to register varas hakka and get my mother name added in sathbara. Also tell me how to do mojani.

For mojani information i.e. demarcation you will have to make an application to the TILR office along with names and addresses of the adjoining land owners. For waras hakka nond you have to give application to talathi office along with affidavit of all legal heirs i.e. waras.



Q: Procedure for the payment of the college fees in case to discontinue.

Hello, I student of MC2academy at Shivajinagar branch Pune. I took the admission on 6th September 2017 but because of some serious family issue I need to go my home( sangli). Therefore, it would not possible to me to attend class. I talked with them regarding my issue and I asked them for refund ( at least 80%) but they are saying it is against their refund policy. Please tell what can I do and how can I get my refund.....

A notice demanding the amount needs to be issued to the institute. Even then if the amount is not refunded, a complaint in Pune District Consumer Disputes Redressal Forum will have ton be filed for recovery of your money and also damages for mental agony. Before doing this, the terms and conditions on the prospectus, if any, needs to be studied.
