Questions Answered by Advocate Rahul Singh

Q: Denial of Family Pension under Rule 54(11-C) CCS Rules for Sec 306 IPC

My father died in service (IISR) in 1995 and my mother was convicted under Sec 306 IPC (Abetment of Suicide) & granted Sec 4 Probation of Offenders Act by HC in 2024. IISR rejected thefamily pension citing Rule 54(11-C) CCS Pension Rules & Sec 25 Hindu Succession Act. Both rules strictly apply only to "murder" convictions, not suicide. Since pension is a statutory right and Sec 306 is not murder, is this rejection legally valid? Can I successfully challenge this in CAT to get my pension/arrears?

Advocate Rahul Singh answered
Hey,Going by the brief facts stated by you, the rejection of family pension by the employer appears legally questionable and open to challenge. Under Rule 54(11-C) of the CCS (Pension) Rules and Section 25 of the Hindu Succession Act, 1956, disqualification is specifically attached to cases involving “murder” or “abetment of murder,” not merely abetment of suicide under Section 306 IPC. Since Section 306 IPC is a distinct offence and does not equate to murder under the Indian Penal Code, extending these disqualifications may amount to misapplication of law. Further, grant of benefit under Section 4 of the Probation of Offenders Act, 1958 indicates absence of severe penal consequences, which may strengthen your equitable claim. Family pension is considered a statutory and beneficial right, and its denial must strictly conform to governing rules. Therefore, I can suggest that you have reasonable grounds to challenge the decision before the Central Administrative Tribunal and seek arrears thereof. Just for the information, I appear regularly before the CAT, Lucknow Bench, and have good hold there.

Q: motorola phone dead after Software update

The case is about Motorazor fold phone which I bought in September 2024. Recently, the phone was demanding a software update which i did whenever notification comes. Post update, the phone inner screen gone completely blank and outer screen took 18-2- minutes to get started adn get heated like anyhting. Now motorola says since phone is out of warranty so I have to pay the charges to get scren replaced. pl guide

Advocate Rahul Singh answered
Hey,Going by the brief facts it is clear that you case involves potential deficiency in service and unfair trade practice by Motorola. Although the device is out of warranty, the defect appears to have arisen immediately after an official software update pushed by the manufacturer, not due to user misuse. Under the Consumer Protection Act, 2019, a manufacturer can still be held liable if a product develops faults due to defective software, latent defects, or negligent after-sales service. Forcing you to pay for repairs in such circumstances may amount to deficiency in service. It is my advise that hay you first send a legal notice demanding free repair or replacement, citing that the defect was triggered by their update. If unresolved, you can file a complaint before the District Consumer Commission seeking repair, replacement, refund, and compensation. Preserve evidence such as update logs, service reports, and communication with the company to substantiate your claim.

Q: Attendance When Proceeding Stayed by Allahabad High Court

Hi Sir/Madam,My case has been stayed by Honorable Allahabad High Court as "proceeding stay". I need to know, that after this, should I need to present myself for aattendance in District court regularly or my attendance will also be stayed/forgiven due to stay? Please help.

Advocate Rahul Singh answered
Hey,Going by the brief facts that you have mentioned, when the proceedings in your case have been stayed by the Hon’ble Allahabad High Court, it generally means that all further trial court proceedings are temporarily suspended, including hearings before the District Court. Consequently, your obligation to appear for regular attendance is ordinarily kept in abeyance during the subsistence of the stay order. However, this is not absolute. You must carefully examine the wording of the Hon’ble High Court’s stay order. If the stay is unconditional and applies to the entire proceedings, personal attendance is typically not required. But if the order is limited in scope (e.g., stay on final proceedings only) or if the District Court has issued specific directions regarding presence, compliance may still be necessary.

Q: Vacation-membership-issue-carribean-holidays

I had purchased the membership vacation domestic plan from carribbean holidays international 35 days +14 days. Paid 80000+ AMC charges. I had not used from last one year. Two times I ask them to book, 2 room for my family members. They refused to book 2 rooms, instead ready to book 1 room and sayings in your membership applicable for 1 room. However when they sold to me. They told me you can book 2 rooms against the no of days, 2 rooms will be treated as count as 2 days from membership.

Advocate Rahul Singh answered
Hey,See, at the outset, your case concerns misrepresentation and deficiency in service by Caribbean Holidays International. Going by the facts that you have written, you purchased a vacation membership (₹80,000 + AMC) based on a verbal assurance that you could book 2 rooms simultaneously, with days deducted accordingly. However, the company is now restricting you to only 1 room, which contradicts what was promised at the time of sale.Legally, this raises two key issues. Under the Indian Contract Act, 1872, this may amount to misrepresentation, since you were induced into the contract by misleading statements because even if the term is not written in the agreement, oral promises and sales representations are legally relevant if they influenced your decision and further, Under the Consumer Protection Act, 2019, this is a deficiency in service and an unfair trade practice, as promised benefits are being denied. My sincere advise to you would be to send a legal notice demanding either fulfillment (2-room booking) or a refund. And if furtherance thereof, file a complaint before the Consumer Commission seeking refund, compensation, and costs.
