Q: Fake 494 case filed by wife against husband what to do

Wife filed fake complaint 494 against husband and mentioned the name of a girl as accused in FIR for second marriage (fake 494 compliant). What steps need to be taken? Also what are the rights of girl mentioned in the FIR? Is it right to mention the third perosn in the FIR for 494?

Advocate Rahul Gautam Awhad answered
Section 494 of IPC is Marrying again during lifetime of husband or wife.— Its bailable section . First u seek for bail other wise take anticipatory bail. If wife have any acknowledged abt yours second marriage and have any proof of you second marriage so she have right and she can mention the name of that lady in fir . If this allegation and Complaint is false then you can file write pettion befor honble high court for quashing of fir.
