Please note that under Section 138, Negotiable Instruments Act, 1881, a case is maintainable only when the cheque is given for the discharge of any debt or liability. [Refer to Section 138 of Negotiable Instruments Act, 1881]However, as per the facts of your case, since the cheques was stolen and it was not given by you to discharge any debt or liability, the case of the respondent is not good at law. In other words, the onus would ultimately lie on him to prove that the cheque was given to discharge any debt or liability. In fact, it can also be presumed that you have given a loan to that person by cheque.Moreover, I would advise you to file a FIR against the person for stealing the cheque at the earliest which will make your case strong.Please note that this advice is on the basis of the limited facts provided by you.
