Q: How can I get custody of my one year old child?

Me and my wife is leaving separately. My 1year baby is leaving with my wife. I am going to take divorce with my wife but I want my baby custody. My wife is only B.A, her family is not financially strong and not able to take full responsibility of my baby. Please suggest me How can I take custody?

Advocate Pratyush Chaube answered
You will have to file a case for child custody in the concerned court of the place in whose jurisdiction your residence is located or your wife's residence. You can prepare your ground which are favourig you for the child's betterment and custody but try to focus on solid grounds as the child is very small and young and most of the times where the child is toddler the court favours the mother.

Q: Can my wife or my son can claims on my mom's property?

My mom is the owner of all properties and my son is only one year old. And my wife is living with my son in her own family not in-laws family, means separate with me. Can my wife claims on my mom's property for my son? Will my son has any right to take my mom's property in future? If my mom gives gift all properties to anyone, So my son can claim on that property in future?

Advocate Pratyush Chaube answered
First of all, it is relevant to know that the whether the property owned by your mom is her self acquired or transfer from your dad, if that property is transferred from you dad your son has the right to claim that property and if he is minor your wife can be his Guardian for the suit. Also is that property is made by your mother's earning your son has the first right on that property after you.

Q: Terminated because of the wrong sequence of my degree

I am an assistant professor in an engineering college, in my previous job I was terminated from my job because of a little confusion.Confusion on sequence of qualification. According to AICTE norms for be an assistant professor in computer science branch u must have the degree of btech & mtech in computer sc. & engineering . sir I m holding both degrees from recognised universities r also approved by AICTE & recognised by UGC.I have done b.tech in cse branch after m.tech on the basis of my 12th(pcm) .acrding to rule I can teach, but they told me how can u show ur btech after mtech.thanks

Advocate Pratyush Chaube answered
Your case is interesting and you are correct that sequence of degree cannot bar and cannot be a ground for termination you will have to thoroughly go through your service rules as well as appointment letter and there you will have to find the specific thing which is against you and if there is nothing you can file a case for your reinstatement in service. But you will have to prove and show a cause to satisfy that you have degree of B.tech post to date of M.tech.

Q: On stamp paper there is spelling error will it be a issue for selling

My Flat , got registered couple of years back. Yesterday while checking the Stamp Paper on which registry has been executed, I found that while all the details on all pages of the stamp paper are correct, but at the back of the stamp paper where it is written in hindi the spelling of father's surname is incorrect, other details are ok. It may be noted that only the back of stamp paper is in Hindi, rest all the pages are in English and there everything is correct. I would like to can this be an issue when i try to sell off flat my flat, if yes how can I get this corrected.

Advocate Pratyush Chaube answered
No, this cannot be an issue while selling your property and can be taken into typing error and also there are several other places where your father's name will be written and correct. Also, it is relevant to mention here the first page is important where the sale is transferred for one person to another. Try to convince to whom you are selling. I think it will not be treated as any issue in selling.
