Questions Answered by Advocate Pawan Verma

Q: Company is Asking for termination amount and threaten to terminate me.

I joined an edutech company on 28th August, which is based in Mangalore. Now, on the second day, they have threatened me that they will file a lawsuit for breaching the contract and demand the money. I want help regarding it.

Advocate Pawan Verma answered
Since you have joined only recently and the employer is threatening legal action for an alleged breach of contract, do not panic or make any payment merely because of a verbal threat. First, carefully review the appointment/employment agreement, particularly clauses relating to notice period, probation, termination, training costs, confidentiality, intellectual property, and any stipulated damages or bond.Ask the company to communicate its allegation and the basis for the proposed claim in writing. Preserve your appointment letter, employment agreement, emails, WhatsApp messages, salary records, and any other relevant communication. Avoid signing any undertaking, resignation letter, settlement, or admission of liability without taking independent legal advice.Under Indian contract law, an employer cannot automatically recover whatever amount it demands simply because a contract contains a monetary clause. The enforceability of such clauses depends on the wording, circumstances, and applicable law; courts may examine whether the amount claimed represents legally recoverable compensation. Employment-related restrictions can also be subject to statutory and judicial limitations. If you wish to leave the company, communicate your resignation professionally and follow any valid contractual notice requirements, unless there is a legally justified reason not to. If they send you a legal notice or threaten proceedings, have an advocate review the agreement and respond formally. Do not ignore a genuine legal notice or court summons.

Q: How disowning son can save other relatives from his bad deeds

Son is doing bad acts while staying in parental property. Other relatives also facing issues because of all this. He has been to jail also but even after returning he has no remorse. If legally parents disown him, will it save everyone from any legally issues in which he will be involved

Advocate Pawan Verma answered
Disowning or legally distancing parents from an adult son may help establish that they are not responsible for his independent actions, but it does not automatically protect them from every legal issue. Generally, parents are not liable for the criminal acts of an adult child merely because he resides in their property. However, liability may arise if they knowingly assist, conceal, shelter him to evade lawful action, or are themselves involved in any offence. If the son is causing serious problems, the parents should document incidents, avoid participating in or facilitating his conduct, and consider informing the appropriate authorities where necessary. The exact position depends on the son’s age, the nature of the offences, ownership of the property, and the applicable personal and criminal laws. A lawyer should review the facts and advise on lawful steps such as eviction, protection orders, or other appropriate remedies. please tell me full facts so that I can give us best advice
