Questions Answered by Advocate Parvez

Q: About payment of full course fee

I have given an affidavit with 100rs stamp paper to the college stating that if i cancel the admission, I'll have to pay full 4 years course fee. I submitted it in hurry hence didn't read it properly. Now i want to cancel or withdraw my admission in my 2nd year. Is there any way i won't have to pay full 4 year course fee? I don't want refund of the fees i paid.

Advocate Parvez answered
Let me analyze this situation under Indian law:1. Legal Status of Such ConditionsAccording to several Supreme Court and High Court judgments in India, educational institutions cannot force students to pay the entire course fee if they withdraw mid-way. This stance has been consistently upheld based on the following principles:- In Islamic Academy of Education v. State of Karnataka (2003), the Supreme Court held that institutions can only charge fees for the actual period of study- Such restrictive conditions are considered a violation of Article 19(1)(g) of the Constitution (right to practice any profession)- These conditions are viewed as unfair trade practices under consumer protection laws2. Validity of the AffidavitDespite being on stamp paper, such an affidavit would likely be considered void because:- It goes against public policy- It imposes an unreasonable restriction on the student's fundamental rights- Courts have held that educational institutions cannot enforce such punitive measures even if agreed to in writing3. What Can the Institution Legally Charge? The institution can typically claim:- Fees for the period actually attended- A reasonable notice period fee (usually 1-3 months)- Any genuine expenses incurred by the institution- Security deposits can be forfeited as per reasonable terms4. Key Legal PrecedentsIn Vinayaka Mission University v. S. Arun Rajesh & Others (2012), the Madras High Court held that demanding full course fees for the entire duration when a student withdraws mid-course is illegal and amounts to profiteering.5. Student's RightsThe student has the right to:- Discontinue education at any point- Pay only for the period of actual study- Challenge such conditions in consumer courts or regular courts- Seek refund of excess fees paidRecommendation:1. The student should formally communicate their decision to withdraw2. Offer to pay fees for the completed period plus reasonable notice period3. If the institution insists on full payment, they can: - File a complaint with the state education department - Approach the consumer forum - File a writ petition in the High CourtThe affidavit, despite being on stamp paper, cannot override established legal principles and court judgments. The student is not legally bound to pay the entire course fee, as such conditions are considered excessive and unenforceable in Indian courts.

Q: Boundary Wall dispute with neighbour

Can date of sale deed of plot holder & date of transfer of plot ownership of deceased neighbour to heirs be a prime legal factor in boundary wall dispute?

Advocate Parvez answered
Yes, the sale deed date and ownership transfer data can be key in a boundary wall dispute. if your sale deed is older, your boundary rights may be stronger. if the wall was built after your purchase and encroached, you can challenge it. Mutation records, land survey and possession history are crucial. Legal remedies include survey demarcation, injunction and possession suit.

Q: Recover money from partnership deed investment.

I have invested in a partnership deed with a builder for development of a property and a notary has been registered for that in Surat Gujarat. Now after 4 years the builder is not even returning the principle amount saying the there is no buyer for that property. There is one more invester with me who has invested in that and included in the notary document. Plz guide what are the legal steps to be taken to recover the money.
