Q: Deficiency in Services of Management committee of Society
I am facing problem of Seepage from the roof . Upper floor owner not willing to rectify it . Society Management committee not pursuing the owner of upper floor flat for rectification. I am facing this for last 4 years and grievance remains unresolved due non co operation of society management and upper floor flat owner. I want to claim damages and compensation against the society management .
Advocate Parth Lalai answered
Send a legal notice outlining your concern to the society secretary or chairman. If no action taken still, make sure you have all your correspondence relating to your issue compiled and then you can proceed to file a complaint in either the cooperative society tribunal or at the district consumer forum level. It is important to determine the exact “cost” that you have lost and put a figure on that as well. Please contact me if you want to speak further. Thanks.

File a complaint for deficiency of services and negligence. Interpretation of any existing terms qua the payment and installation will be key to proceed further. Any refund terms and conditions and/or invoices will be the most helpful for a quick track procedure at the forums.
Q: Organization is not releasing full and final settlement
I was working as a teacher in Pune. I resigned from the school because my husband got a job elsewhere. When I resigned the HR told me that they will not release the deposit amount which is equal to one month of salary which they kept with themselves when I joined the organisation on 11 September 2023. I got an email from my school saying that they will not give my full and final settlement also because I did not serve the notice period of 3 months.
Advocate Parth Lalai answered
You need to send a Legal Notice immediately. Retain any records of FnF correspondence as proof of amount due. Interpreting your employment terms correctly will be key since that will be the basis for all further demands.
