According to transfer of property act you first go to district talati office and so them a copy of purchased document and in your index 2 copy where your name is present then talati officer verify your document then talati officer give you the form for adding your name in your property so this simple procedure don't worry about that so first you go to talati office.



Q: Rights of children on father's property after his death

My father had expired in 2000. I am a Hindu.The property and assets were transferred automatically in my mother's name after my father's death. I have one elder sister.Do I and my sister have rights on house/ property.Can my mother transfer my father's hard earned property on any ones name in her will ?If the house property is to be divided amongst mother, me and sister, will the house have to be sold for division of property?

According to transfer of property act 1882 said that your mother and you and your elder sister is the legal heirs of your father so here either your mother live or expired the share of property and asset will be you and your elder sister so if you want to transfer your share separately then you can sale separately.

According to Hindu succession act 2005 the share of the your family flat Will be equal whether boy or girl the sharing will be equal proportion when you sale your Mumbai flat then your brothers share and your single sister share are equal means Whatever you get it will be divided by four parts according to law.

actually my husband died 2 yrs back & i hv 2 children my in laws stopped supporting me financially after my husband died i started wkg n now i had to shift to my mothers place coz i couldnt support my children need to kw what r my rights over the property owned by inlaws need to consult free coz already burdened vth my expenses

You have equal right in your laws like your husband but unfortunately your husband died though you have total rights of your husband according to tranfer of property act 1882 said that laws definitely support you because of their family childs care by you only so don't worry it is the duty of your husband family supporting you financially otherwise you contact a good lawyer and take immediately action through appropriate court against your husband family.

We have ownership flat in Mumbai in joint name of myself and my wife.If we nominate each other in our co operative housing society,after death of any one of us,the flat will be transfered to the survivor or the flat will be transfered to legal heirs. Please advise

According to transfer of property act 1882 said that if a property in a joined name suppose if one party died then it will be transfer his share to his legal heir in your case you both are husband and wife here nothing problem created if one party died then altimately his right gone to your Legal heirs.
