If police officer is not hearing you.you need to make an application in the name of S.P.(superintendent of police) of your area and write your all problems and send it by post.under section 154 of cr.p.c. any person can sent his complaint to the S.P. ,when police don't hear you.

Q: Legal remedy against parents forcefully Living with married couple

I am at the age of 31 years and recently got married. I am in earnings from last 5 years. I have borne all the expenses of my education from Graduation and currently a chartered accountant. I am the only son of my parents. I have own borne the whole wedding expenses on my own marriage. I am not enjoying the ancestral property and currently living on rent with my wife. I have asked the parents to come and live with us at Lucknow. Parents came to Lucknow but now they are interfering in my personal married life. They are abusing us daily and imposing restriction that we can not visit the market or any other place. I have told them to go back at their own house located at gorakhpur but they denied and replied they shall interfere in my personal life. Since I and my wife both are working and surviving on own income we want to know whether we can take legal action against them as they are forcefully living in my rented house now and abusing and shouting on us?

Dear friend, you problem is unique. You are very lucky that your parents are with you. I suggest you try to understand them as you are the only son of you parents.life is so short,nobody knows when he will die. Think only once that if your children behave you like that,and you have only one son and you are old ,what will you feel. Before I reply your answer I want to know whether your parents have any earning and is anybody to take care your parents other than you? As your parents have right to force you to take care under section 125 Cr.p.c. if they have not sufficient means to maintain themselves. You need a professional lawyer like me who can better assist you in this matter.

Q: How much time does it take to conclude a child custody case

Sir I have filed a case in family court regarding achild custody but two date have passed and the opisition party didn't present can i nkow if there is any early process because the date in family couts are very long

Dear sir, it depends on your lawyer whom you have hired for this case.It also depends on judges and more it depends what other party wants.You need good Advocate who is proficient in this field. Such cases generally take 3 to 6 months which may extend to more.You may contact for further assistance.

Q: What to do if I am being harassed by in laws for dowry?

My in laws and sis in law always mentally torture me.my father in laws torture me for dawory and they also abuse me and my family .. Please help me..Give me the right solution for this problems.

There are various laws which protect women form being harassed by her husband or by other person .As your wellwisher I want to suggest you that you should resolve your problem with talk to your husband, because it is very easy to take divorce rather to protect marriage life.My first preference is to protect marriage rather than to break it. Be careful while taking legal recourse because in many cases I see the result is breakdown of marriage life. If your husband is not ready to hear You, you can file case against them for metal cruelty and harassment under section 498A of I.P.C.; There are other provisions too, which you can parallel imposes on them.

Q: How can we seek maintenance for baby and wife?

My sister got married to guy in 2013. Post marriage, she has been emotionally and financially tortured by her husband and in laws. So after 3.5 yrs of tolerating all dat, she finally gave up and left her matrimonial home and came to her paternal home wid her 1 yr old kid. We wanted to settle things and send her back but due to her husbands financial mess due to meagre income and extravagant lifestyle that includes buying expensive sunglasses, shoes, smartphones, car,etc. But as a father and husband he has minimal duties towards his son and wife which he clearly refuses to do. My sister has been asking for her minimum rights in the form of little amount to just take care of her baby and herself but everytime she does so he fights or shows aggression which makes is determined that we cant send her back to him as he and his family would do more emotional and financial torture. So we want to send him a notice seeking monthly maintenance. Pls advice the steps

Dear Sir, There are various laws which protect women form being harassed by her husband or other person. But as your wellwisher , I would like to suggest you that you need to resolve your sister's problem through peaceful talk with her husband. It is very easy to take divorce rather than to protect marriage life.My first preference is to protect marriage rather than to break it. So be careful,if you take help of court, in many cases the result is breakdown of marriage life.If the husband is still not ready to hear you, you may take legal recourse. If your sister is seeking for maintenance for herself and for her child, she can claim under section 125 of Cr.p.c. ;There are other provisions too , to claim maintenance or to protect marriage life.
