Q: False allegations of physical harassment by aunt & cousin sister

My cousin sister and my aunty always put false allegations of physical touch or harassment on them by my father and me. The police personnel also takes their side and tries to abuse us and try to create fear of filing an FIR and arrest us but due to some strong relatives we are saved. So in this case can police arrest us ? How can we file up a case against them in order to teach them a lesson because we work in armed forces and they taking advantage and trying to remove us from service by putting false allegations. Kindly suggest us to take necessary steps in order to live freely.

To prevent any further damage to that child's psychology, India has prevention of domestic violence actYou may Report the case to that family's nearest Police-Station. If you have some evidence, it will help police to prima-facee accept the complaint in writing and give you a copy of it.

Q: How to claim Solatium fund in a hit and run case

Hi Sir, My father was a victim of hit & run motor case in the year 2006. He has been living a painful life since then. Now I have come to know something about solatium fund that hit & run victims can receive. Can you guide us if it's applicable to us. Thanks Amit

Advocate Mohd Aman answered
In ‘Hit & Run’ cases, accident victims are eligible for compensation through a Special Fund constituted in terms of Section 163 of the Motor Vehicles Act, 1988 called ‘Solatium Fund’. The amount of Compensation is `25,000/- in the event of death and `12,500/- for grievous injuries. A portion of the Gross Written Premium is contributed towards this Fund every year by both Public and Private Insurers. However, in case the vehicle is without insurance, the victim/dependents has the right to claim compensation from the owner/driver under Motor Vehicles Act, 1988.The Sundar Committee appointed by Ministry of Road Transport & Highways (MoRTH) has recommended that the Certificate of Insurance should be co-terminus with the validity of Certificate of Registration of the motor vehicle.

Q: Remedy as girl married concealing the fact of suffering from epilepsy

Hello, My parents are living with my sister in law as, my brother has a touring job and also my sister in law has some severe medical issue such as, she is suffering from acute epilepsy. We didn't know about her problem, her mother and elder brother cheated us without telling anything they performed marriage in Feb 2015. We knew this thing in oct 2015, when she got fits. She conceived in 2016. Now, the situation is because she is living with my parents she always tries to move out with her husband separately but the reality is she is not mentally stable, she is not able to take care of my brother’s 2-year-old boy, any time she can get fits and after that, she was senseless and unconscious and my brother has a touring job. the problem is, she and her brother (living in a same city) are always creating problem for my elderly parents, they always give police dhamki to them for any single things. I'm requesting here, please help me and suggest some legal requirements.

Advocate Mohd Aman answered
Go to the nearest police station n file a complaint n take a copy of that report if nothing happens, again go to the authorities and file a complaint. This time make a complaint before the superintendent of police. It is very unlikely that nothing happens again. If nothing happens again, the last recourse which I can think of is, judicial one.now you can take judicial recourse by filing a complaint before the magistrate. That your family cheated by them
