I m 75 Year old hindu lady, my elder brother has expired, he has 3 middle aged children (1 boy, 2 girls) and a wife who is alive, my younger brother is alive and my younger sister has expired she has i child and her husband is alive. My father had a property in Mumbai and he died without a will, now after several years we have a buyer for the said property who has made an offer, we all have agreed to the price offered but only the youngest daughter of my Deceased Elder brother and her husband have denied to accept the offer and they want us to negotiate more from the buyer. The buyer has said a no to further negotiations and now the younger daughter and her husband have categorically said they will not yield. We all, myself, my brother, expired brothers wife and my expired sisters husband are all above 70 Years of age, is there a law by which we can come out of this harassment by my niece and her husband who have held the majority of us to ransom or will we die without help???

contact an able and competent lawyer after confirming his credentials and taking care to see that he would not exploit you and try to drag the matter for years for his own benefitsby taking advantage of present judiciary and unpleasant practices that are taking place all over india and in at all levels .... take such lawyer as a middleman who would be in a better position to study your case from all angels.... would know true valuation of the property so that you would be able to fetch much much more value for your property so that other side would also get amount to her satisfaction and you would also get more value for your property.... and fees paid to him will be out of said excess amount of valuation... which you might not have imagined... hence for you free of costhowever as stated earlier... please note that most of solicitors and advocates , if you approach.. would not give you proper advise and hold your property ... ask you ro indulge into litigations which will remain pending for years at all levels as is unfortunately happening in our country in view of prevailing practices and procedures which may not change so soon good luck...

Q: Co owners are not giving consent for sale of a joint property

My grandfather have 3 brothers and 3 sisters. A quite large piece of land (home) was owned by their father who passed away and the land now belong to my grandfather and his siblings. Of the 6 siblings 1 brother and 3 sisters left the home and only my grandfather and his 2 brothers stay here currently. They have divided the house in 3 parts among them selves. My grandfather want to sell the part he has but due to internal grudges nobody is ready to give their signatures to sell the part of house. Please guide us what should we do ? The house was built in 1949. We are Brahmins.

Q: How to make gift deed null and void

As part of a negotiation proces (read as "divorce"), i had agreed to give my 50% share in a residential property to my wife. The same was to be done via a gift deed. The property is currently under 2 loans with a bank (base & top up). It was agreed in the gift deed that the Donee (my wife) will get both the loans transferred within one month of signing the gift deed. In order to get the loan transferred, she asked for the original gift deed copy to be submitted to bank. This was provided. Later I realised that they have left the city with the original gift deed (I have an attested copy), without submitting the papers for loan transfer. Question: How can I make the gift deed null and void basis the clause that the loan was not transferred?

Advocate Mohan Rane answered
