Q: Cancellation of warrant in husband name for non payment of alimony.

Dear Sir,n I got married in 2016. My wife and her family had filed DV Act cases 498A cases and demanding alimony. I did not pay alimony. We have tried to settle the matter by one time payment. The are demanding Rs 10 lakh. We are givung the 3-5 lakh but they are not agreeing for itNow court had issued warrant in my name. Please help me in getting divorce and revert solutions and your advice regardingnna) How to seek divorce from her?nnb) How to cancel the warrantnnc) How to enforce them to settle the matter in Rs 3-4 lakh?

first of all you must appear before the court from which you received the summon/ warrant and get it cancelled with the help of your Advocate.As far as settlement and alimony part is concerned first you appear before concerned court and negotiate accordingly without taking active as well as physical participation you will not reach to any conclusions and the demand of your wife is not genuine then you can fight on merit and finally court will decide in all cases.....Rest upto you how to proceed

Q: Validity Of MOU In Family Matters

If any mou is signed on which it is written that no dowry was taken nor demanded can it debbared to file cases or will be hurdle in future if dispute arises again

Firstly you have to challenge the sanctity of the MOU and in what conditions it was signed and what prompted you to abide by the terms and conditions of the MOU. generally are signed between both the parties to clarify all the points of issue and and for their settlement . In case any dispute arises and one of the party do not comply with the terms and conditions then the aggrieved party can the door of the court to get his or her grievance settled.

Yes You can claim alimony and it would be given to you as per law.In your petition you have to write each and every detail to get alimony..However it depends upon case to case that how much alimony you will get

My father is very abusive and intentionally create problems for me. His brothers kicked him out of his home now he is staying with me in Bangalore and he has become bottleneck for me. I don't want to have any relationship with him. He is having issue in legs and not able to walk independently. So I need to know what options I can have to disown him. He is mentally harassing us (me, my mom and my sister)

You are legally bound to maintain your father at his old age and as per Maintenance and Welfare of Parents and Senior Citizen Act. If you shirk from your responsibility as a son then your father might take any legal action against you. It is your prime responsibility to take care of his wellness and for that you can medical treatment for him and also get him shifted to a wellness centre or homecare.

Q: Court fees on Dowry amount which has been captured by boys family

Hi,nI have files 2 cases in family court one is divorce and second one is to get my things back, Fürther I have got the court order in my divorce case, however in Saman vapsi case it is pending for final hearing as opposite party is asking to pay the court fee on the total dowry amount, I am liable to pay the court fee on dowry amount, Please advise.

If you are seeking recovery and refund of dowry amount, as per Court fee Act, you have to give ad valorem court fee as per suit valuation i.e total value of your dowry amount. Non filing of court fee is one of the ground of rejection of case/ plaint.
