My father passed away 3 years ago and after that my grand father died, but he did not make any will. So in heir investigation paper can I mentioned my married sister name? My cast is hindu maratha.

yes you may add the name of your married sister name. every child born whether legitimate or illegitimate are have equal rights on the property when there is no will. you may add your married sister name in the document .

Q: Change of surname after marriage

I need to get my wife's surname changed post marriage. Our marriage took place in a church in Thane city in 2016. We are at present residing bin Ahmedabad city. What is the required process to be done ?

yes. you can change the name post marriage. you would require few documents to prove your marriage and we can apply for name change. one of the important thing is you also need to publish or annouce in newspaper.

Q: I don't want to divorce but my husband want it

My husband wants to give me divorce without giving me alimony , I have one year old daughter, can i get rights over my in-laws property

She is not adjusting with me as she extremely short tempered and suffering from mental illness. We have two children of age 12yrs and 15 yrs. She is also want to divorce.

if both the parties to marriage need divorce you both may opt for mutual consent divorce. before ending your marriage make sure if matrimonial dispute is irretrievable and reconciliation is not an option, you both may file mutual consent divorce petition in family court.

Q: Can I get money back spend on my husband during our marriage

I have been separated from my husband since August 2013. My husband threw me out of the house in August 2013 because I was not ready to pay his home loan as he wanted to go and work in the gulf. Since den we have not met or stayed together. I want ty o file a divorce and want all my money that I spent taking care of him and his mother and paying all the bills and loan for him. Now he is working in Dubai. The last I wrote to him was to returning my money which he said he would but I don't think he will. How do I get my money back n file for a divorce. Plz help me am not from a well to do family

Dear, You please talk to your husband if he is ready for divorce in an amicable manner.As even he is not getting back to you and trying to resolve the tensions occured in your marital life, even he must be thinking of divorce. It will be helpful in filing mutual consent divorce. If he agrees then the problem is solved as he may share the financial burden of filing case.
