Q: Sister illegally occupying property

Good day Sirs/MadamsI own a flat in mumbai ,I am the sole owner, I am resident of Goa. and my Sister and her husband have given the premises on rent, all my property documents are with them and I only have a copy of the share certificate, now that I am asking them to vacate the premises they are not complying, I have asked the society for the copies of the agreement and they are not complying and are supporting my sister, what are my options here since I have only copy of share certificate

Hi, it is firstly advisable to obtain a copy of the agreement from the sub registrars office, you dont need to approach the society or your sister for that you will get it easily from the sub registrars office. Secondly in case if your sister is not vacating the premises, you may approach the civil court for recovery of possession

Q: recovery of payment of outstanding dues

my client had signed a master service agreement to which now the other party has to pay me an amount of 112,116$ the jurisdiction is exclusively given to the courts in New Delhi, India. even after asking for the payment they haven't paid any amount. What legal proceedings shall my client take

Q: Eviction Notice by landlord before Tenure period

Our landlord is kicking us out by giving us a 2 months notice for no reason, our tenure extends till 31st November 2024.We have paid rent on time and maintained the property pretty well. His reason is that he wants to move in, but its before the tenure period and they can't just kick us out while violating the original rental agreement.What should we do about this situation? pls help.

Hi, all agreements have a termination clause. In the given facts and circumstances i apprehend that the owner has given u a notice as per the terms of the agreement. It is important to reply to the said notice in case if you dont want to vacate or in case if you seek more time in vacating the premises

Q: Property Dispute among family got legal notice

My father purchase a flat in year 2005, property was purchased from grand mother. His son is having a extra marital affair and have 1 son from extra marital affair and 3 child from legal marriage. Now his son dead in year 2021 and a son from extra marital affair is giving as a notice, in which he mention that we had purchased a property without his consent.What can we do now. ?Is he has any right in his grandmother property?

Hi, selling of property by a owner needs no NOC from any third party who does not have a legal right in the flat. In the given situation it is adviceable to give a reply to the legal notice received from one of the sons.
