Q: Bank not closing Saving accounts due to credit card hold
Bank is not closing my saving account due to credit Card hold since last 5 years. Is there any legal notice/Legal action whichi can be taken against Bank for closing my saving account. Credit Card and Saving Bank account are different Financial products. However 5 years is a long time to keep hold on my saving account.
Advocate Kuhu Mohan answered
A bank cannot indefinitely freeze or refuse to close a savings account merely due to a pending or defaulted credit card liability, especially when both are separate financial products. As per RBI guidelines and settled banking principles, lien or set-off can be exercised only after due notice and within reasonable limits. A 5-year hold is excessive and arbitrary. You may first submit a written request to the bank seeking closure and reasons for continued hold. If unresolved, you can issue a legal notice alleging deficiency in service and unfair banking practice. Thereafter, a complaint can be filed before the Banking Ombudsman under RBI Integrated Ombudsman Scheme, 2021, or before the Consumer Commission seeking account closure and compensation for harassment. Courts have consistently held that banks must act reasonably and proportionately.
