Q: Pagdi property in Kamathipura in deceased father's name

120 sft area pagdi property tenant is deceased father landlord not giving rent receipts want to transfer the property to one legal heir what are the issues if we transfer it to mother or elder brother which is better?

Advocate Krinjal S. Ahuja answered
before transferring tenancy, you have to get the rent receipt transfer because after your father your mother is entitled for the Tenancy rights. if landlord is not giving tenancy in your mother's name or not accepting rent that means he is creating ground for eviction. my suggestion would be immediately send a legal notice and simultaneously send rent if he is not taking rent by money order. Your first step should be to transfer tenancy in your immediate legal Heirs name that is your mother. firstly resolve this issue, and then you can think about further transfer. Feel free to contact for further assistance.

Q: Regarding sale if flat on which court put stay in domestic violence ca

Advocate Krinjal S. Ahuja answered
Take help of your existing advocate who is handling domestic violence case, he or she will take steps to bring this facts before the judge and take stay order from court against the said flat immediately. for further assistance pls feel free to contact.

Q: Landlord is refusing to return security deposit after leaving the flat

On April 2022 I rented a 1RK flat for which I have paid ₹6500 as a security deposit +₹3500 as the rent of the month. No legal agreement made, on 28 Feb2024 I have vacated the property but citing many reasons the landlord is refusing to return security deposit, what are my options now ?

Advocate Krinjal S. Ahuja answered
In absence of any agreement, there is only 1 option. File a police complaint stating cheating and fraud. if u have any evidence of deposit paid show to the police officer or any witness. Premises was rented to you and you hav stayed there, landlord can deny that. it's only question of deposit which is being malafidely forfeited, citing false baseless reasons inspite of rent being paid on time. File Police Complaint. for further assistance pls contact.
