Single flat Owner died without nomination n will and his son asking for society NOC in the name of all legal heirs (mother n his brothers n sisters) to sale the flat.\nCan society give NOC in name of all legal heirs to sale flat and what documents society need to take in this case .

No society cannot any issue any NOC on behalf of any legal heirs of deceased. Society has no such right. In such case, either,1. all the legal heirs can if there is no dispute between them w.r.t flat appoint son as nominee and give him authority to administer flat however if he sells the flat then he has to share the consideration received amongst all heirs as per succession law.2. Since the deceased dies intestate and of property is located in Mumbai or Maharashtra then the legal heirs have to approach high court in whose jurisdiction the property lies to obtain succession certificate from court and it shall be distributed amongst all legal heirs as per succession law.
