It is your personal decision to make. However it is always recommended to tell the truth to your future partner about your past relationship status if thats a deal breaker, to avoid further complications.
Q: Hindu married woman wanting to get a decree of judicial separation
I am a married Hindu woman in an abusive marriage . I want to leave my husband immediately on grounds of cruelty and enter into a live in relationship with my friend . What are my options and how can I keep myself safe from future legal action ?
Advocate Keyur Kulkarni answered
You need to apply for divorce if thats what you want. However, I won’t recommend immediately entering into a live in relationship and wait for decree of divorce. Once you get a decree, you are free to do whatever you want.
Q: Property fully maintain by me for 25 yrs But owner want it now
A property was verbally given to me. I was fully maintaining and repairing the property. The owner never came to have look at property for the last 25 yrs. Even the property tax was paid by me. Now he wants the property back as it is still in his name. Can he legally claim the property.
Advocate Keyur Kulkarni answered
It completely depends on the communications, verbal or written, that may have taken place between you and the owner. If there was no claim on the property for past 25 years, you can surely claim the property as adverse possessor.
Q: Step parent adoption /GWA /HAMA /CARA
In Akola Family Court, Maharashtra, after mutual divorce where biological father defaulted on ₹5000/month maintenance due to alcoholism/neglect, I’ve filed for sole custody/name change under Guardians & Wards Act . Criminal case (filed on ex-husband/family) now at argument stage—they seek mutual withdrawal . Can the compromise deed include a clause for ex-husband’s NOC/consent to my current husband’s stepfather adoption.will this be accepted by Cara.
Advocate Keyur Kulkarni answered
No, this will not be accepted by Cara and you will need a separate NOC and affidavit from your ex husband. You can get this clause included in your mutual consent withdrawal deed. However, Cara will ask for a separate NOC and affidavit from your ex husband
Q: Redevlopment of south mumbai prestigious bldg .
Our bldg is undergoing a redevlopment and one of the most prestigious redevlopment in south mumbai and one of the biggest . The committee has not worked in a transparent manner and has made changes in the layouts post signing the DA . We have opposed the layout and now they are pushing us to sign the Paaa . We have not got the EC certificate and they have passed a resolution in the sbgm to amend the DA regards to this EC certificate and ask us to leave the premises .
Advocate Keyur Kulkarni answered
If the committee has not worked in a transparent manner and has approved layouts which were not passed in the original DA, you have right to file for injunctions against the said action. If after approving the layouts, society got approval for amending the layouts in SGM, it will still not hold up if it is clear that layouts were approved before SGM.Injunction is the recommended solution in your query.
