Q: Need to know if marriage certificate is required for divorce

Hello I am married for 6 years and I want to divorce. We do not have marriage certificate that means the marriage is not registered. We do have photos and marriage invitation. What is necessary to dissolve the marriage?

Hello Sir/Madam,Even in the absence of any marriage proof, you can obtain divorce decree or file divorce petition. If you do not have any marriage or in the absence of such proof, you will have to file an affidavit to that effect.



Q: Alimony, dowry, cruelty and child custody and child support

I had decided to file for maintenance case and if things didn't work out, I would go for 498a, 406,dowry, DV cases.I gave everything in writing to my lawyer so that she can draft to file maintenance case first. I kept scanned copy of that matter in my phone. 2 days later, my husband called me and said that he got access to that,scanned copy and since then he started things doing in his defense. Now my lawyer said we can't file maintenance. Kindly suggest how can I proceed further

Hello Ma'am, Firstly, in such circumstances, you may discontinue the services of your earlier advocate.Secondly, you can prefer an application for maintenance u/s. 125 of Cr. P. C.. Wherein, you can seek the relief from the Court. If your husband has inflicted cruelty upon you, you even file a Domestic Violence petition in the Metropolitan Magistrate Court.

I m Ankit I eloped with my gf in 2019 her family filed a case against me under the followed sec I got bail after 4 months of case filed now the case is on trail after repeat calling her father the complaint is coming on 15 sept for evidence I want to get out of the matter as soon as possible please guide me with the steps ahead

Hello Ankit ji,Firstly, I advise you to kindly refrain yourself from making any contact with the victim or her family members in any manner.Secondly, as your matter is at the stage of recording of evidence and even after the witnesses are summoned by the Hon’ble Court and the witnesses are not turning up or fails to mark their presence before the Hon’ble Court, then you can prefer an application for dropping of witness. Upon receiving such application, the Hon’ble Court will call upon the say of the prosecution or IO. If they fail to give or cite any proper reason. In such case, the Hon’ble Court is empowered to drop such witness.



Q: Compensation Alimony Maintenance

My wife has no interest on me from day1 of our marriage due to forced marriage to her, left 2 years back in front of my family members. Filed sec 9 on me in document mentioned dowry harassment. 100% false. I filed sec 13 1 ia. In mediation center counsellor said it was filed and he said to my wife apply Maintenance case. That means he was not consider my arguments, do I failed? Did judge consider his points? when Alimony or maintenance or compensation applied?

Hi,To begin with, I would like to inform you that your wife has filed a divorce proceedings against you u/s. 13 (1) (ia). I believe that you had appeared in the Court after receiving the summons. As per the guidelines of the Supreme Court, it is the duty of the Hon’ble Court to take steps to save, prorect, and preserve the said marriage, also to take steps and measures to intact the said marriage, which can be done by referring the parties for counseling. Similarly, in your case, your matter was referred for counseling. wherein, the suggestion given by the counselor is not binding upon the parties. if the counseling fails between the parties, then the matter will be once again referred back to the concern court for adjudication.
