Q: wife not allowing to meet child , what should I do ?
hi mam/sir, I want to know how can I meet my baby if my wife is not allowing me to see my child ? Can I take baby back to my home for few days? what to do if mother not allowing father to see child india?
Advocate Jyoti Kolhe answered
you have not mention how old is your baby? where is your wife residing ? how you will take your baby back at your home? if your baby is too small then court may allow you to meet your child on weekend. if you can prove that your wife is not capable to take care of your child then you may ask the child custody from court.Best Regards,Adv. Jyoti Kolhe
Q: confusion regarding mutual consent or without mutual consent
My wife is not coming back to home from last 4months and they are now demanding rs 5 lakhs and she had stolen gold purchased by both the parties they will go for without mutual consent if we dont pay the money and gold purchased by both parties. please confirm for stridhan concept, can i ask them to return mangalsutra and bengles purchased by me. please suggest me cost involved in without mutual consent divorce as we do not trust the girl and her family. and also suggest for alimony amount (my salary 28k in hand) and i am sole earner and my parents are medical patient
Advocate Jyoti Kolhe answered
Hi,Stridhan is the gold and other things which she has received at the time of marriage. (from her parents or your side too). you cant ask for mangalsutra back. you have not mention what is she doing and how much she has studied. on that ground you can fight for alimony. also do you have any kids?Best regards,Adv. you need to file contempt of court. also have you file the parental plan? if not then do that as a priority; where you will get the vacation access, weekend access, etc. and many more responsibility. Best regards,Adv. Jyoti
