Q: मेरी पत्नी दो महिने से अलग रूम करके रह रही है

मेरी पत्नी 2 महिने से घर छोडके बाहर रूम करके job कर रही. ऐक बेटा 18 साल का और बेटी 16 साल की है. मैं private कंपनी मे job करके दोनो का पालन पोषण कर रहा. दो महिने से वो ना तो लडको से बात कर रही ना मुझसे. दोन nerves रहते है. मेरा 23 साल पहले श्यादी की कोर्ट मॅरेज, मैने उसे आयुर्वेदिक डॉक्टर बनाया, उसके बाद उसकी फॅमिली का interference बहुत बढ गया. मेरी मम्मी बचपण मे चल बसी थी पिताजी मेरे शादी के बाद दो साल मे ही गुजर गये. मेंटली बहुत torture कर रहे. हम 4 बहुत सफर कर रहे. अब क्या करू समझ नही आ रहा

if you want to love with your wife then in that case, you can file an application for restitution before the Hon'ble family Court. and during the mediation counselling resolve the issues arising amongst you.

Q: Transfer of Property - Index 2?

Dear Sir,After the death of my parents the society has transferred the house to the legal heirs (Me). I have been given to understand that a Letter of Administration is required in case of ownership / Sale as the same will reflect in Index 2. I do not wish to sell the flat. Do I still need to apply for the Letter of Administration? Do I still need to update the Index 2 in case of inheritance of the property. Thanks in advance

I assume that society has transferred the membership Rights only in your favour. for the ownership rights, if your parents died intested then you will have to obtain the letter of administration in your favour to clear the title in your name.

Q: Deficiency of service from Builder leading to incorrect maintenance

. The builder had combined 2 one BHK flat as he did not have the configuration for bigger flat like 3 BHK. He made the changes in agreement but did not make this correction in municipal drawings. The housing society ignored the agreement but used only the municipal drawings to conclude that I was owner for 2 flats and hence charged maintenance for 2 flats since last 16 years. Numerous follow ups and correspondence followed with builder and Society finally leading to approaching District consumer

you can file a consumer case against the builder on the basis of deficiency in service. Simultaneously file Section 91 dispute against society for wrongful maintenance recovery.you can file civil suit against the builder to regularization of a sanctioned plan with MCGM.

court me civil suit chalu he to pehle issue notice hoyega opposite party ko. wahi suit me injunction ka application karke aap injunction order le lo, take wo jamin kisi or ko bech nahi sakega. or fir suit proceed Karo.

Q: Flat in the joint name of myself & mother . Mother expired

We are registering Release Deed / indemnity bond for a flat in the joint name of myself & mother . Mother has expired . My brother & Sister are signing the document . Also two witnesses - my wife & sister in law are signing . Can they anyway affect my rights being transferred to flat ?

on the basis of your above question it appears that you and your mother are equally co-owners of the said flat and now your mother's demise.in that case, other legal heirs can release and relinquish their rights in your favour by way of Deed of Release which is to be executed and Registered. Moreover, society transfer Application also needs to be signed.
