Q: Lease of apartment before the will is probated
Simple synopsis: •My father owned a self made/ self-owned flat in a CHS in Colaba. •He passed away around 18 months back. My mother passed away more than 15 years ago. •We are a Hindu family of 4. (My father, mother (mentioned above), my sister and me). •The flat was nominated in my favour and based on the nomination, the Society transferred the share certificate in my name •There is a proper Will of my father which also mentions that the subject flat has been bequeathed to me. •There is no dispute between my sister and me. She has given an Affidavit that she has no interest in the flat and the said Will is genuine and she does not contest the Will or the Nomination. •There is no other dispute, no claim, no letter registered with the Society on this matter. •The dues are all paid and clear. The Society MC has advised that until and unless the Will is probated, I (as a nominee) cannot lease out the apartment and they will not issue a NOC. What is the law on the subject?

Inspire of a will duly registered and no dispute from your side it is the procedure in law for will probate. The society is not wrong in this. If they are asking for will probate you have to do otherwise they will not give noc. Either you can lease the flat by telling the society that they are relatives, so they will have to be of your caste. Or you can start the filing process for will probate and tell them that will probate is a lengthy process and I have already filed for it and please grant me Noc so that I can lease the flat
Q: Father's property on rent but wants agreement on son's name
my father has a property..he want to give it on rent but want the agreement to be made on sons name and rent should be given to son

Agreement has to be made in the name of father only. Father can give power of attorney to son and as far as rent is concerned it can be mutually given to son but if you want son's name in the agreement than name transfer procedure has to be followed by way of gift deed or others
Q: What to do if brothers do not agree for selling the house?
My husband has two brother, they have one plot and one flat My father in law is no more.now all they decide to sell the plot and divide money in 4 equal parts including mother. But the elder brother of my hubby start construction in flat without asking my hubby and younger brother. We known this from third person and my hubby and his younger brother want to sell that flat due to money problem . What to do in this situation . And if my mother in law shift in that constructed plot then that plot will be fully of elder brother, then how will divide flat if we sell flat

Before giving any advice it is important to know certain things For eg:- the property is ancestral or self acquired.Was there any will of deceased father.If there is a will then all legal heirs will have to abide according to the will after probating the will.If there is no will then mother is the decision maker and most importantly atpresent the property is in whose nameIf the property is still in the name of deceased father then first the process of name transfer has to be done and then only you will be able to sell the property
Q: Can mother and brother claim share in brother's self acquired property
I had purchased a flat in Kharghar, Navi Mumbai in 2007 and other flat in Pune in 2009. All the money including initial contribution + loan was by me alone but I had added my father's name in good faith in property registration agreement & Loan. For many years I was paying EMIs, Maintenance and everything for both flats and by now loans on both properties are over. Unfortunately my father died in a massive heart attack in 2016 and now my mother and brother are claiming % on both properties. My brother was married but his wife has left him and she has filed a case for divorce which is going on. I am married and we have 2 sons (2 & 6 years). In this situation, I wish to ask if my mother and brother can claim any portion on any or both properties and if yes,how much? Is there any way I can remove my father's name from property documents now?

You will have to prove that the amount paid for Flat purchase was paid by you and not by your father.So your brother cannot claim on your property. Mother may get some share but brother will definitely not get if it is genuinely your self acquired property
