Questions Answered by Advocate Dhanur Singh Chauhan (25+ answers)

Q: Maintenance revision declined by high court

Family court ordered interim maintenance which I filed for review in high court but it was not admitted by the court. What options are available for me now

Advocate Dhanur Singh Chauhan answered
1. Comply with Interim Maintenance OrderInterim maintenance orders are immediately enforceable. If you don’t comply, the opposite party can initiate execution proceedings before the family court, which may include attachment of salary/property or even issuance of warrants.2. Challenge the Order in Supreme CourtSince your review in the High Court was not admitted, you can explore approaching the Supreme Court through a Special Leave Petition (SLP) under Article 136 of the Constitution. The Supreme Court entertains SLPs in cases where there is a substantial question of law or grave injustice.3. Modification / Cancellation Application in Family CourtSection 127 of the CrPC allows you to apply for modification, cancellation, or alteration of the maintenance order if there is a change in circumstances (for example, financial hardship, loss of job, or if the spouse has independent income). This can be filed directly in the same family court which passed the interim order.4. Writ Petition (if maintainable)In some cases, if there is a violation of fundamental rights or a jurisdictional error, you may file a writ petition (Article 226/227) in the High Court. However, this depends on whether the High Court has already dismissed your review in detail or at the admission stage.5. Settlement / MediationMany family courts encourage mediation. You can negotiate a lump sum or reduced maintenance through settlement.

Q: A false FIR has been lodged against me under dowry cases

Can this FIR be quashed by Allahabad highcourt or what relief can I get from highcourt?

Advocate Dhanur Singh Chauhan answered
The High Court can quash such FIRs under Section 482 CrPC, but only in limited situations:1. If allegations are vague, absurd, or entirely false – e.g., if no specific role is attributed to the accused, or distant relatives are unnecessarily roped in.2. If it is a pure matrimonial dispute and the parties have reached a settlement/compromise – the Supreme Court has held that in matrimonial disputes (including 498A cases), FIRs can be quashed once husband and wife settle the matter.3. If continuation of proceedings is abuse of process of law – e.g., where FIR is filed only to harass. I can help you in this.

Advocate Dhanur Singh Chauhan answered
2. Right of Pre-emption / First Right to Purchase

Q: Legal Guidance on Selling Ancestral Property with Lost Registry

I have an ancestral property of my late grandfather. He left an un-registered will in my name. The original property registry document has been lost. I have already filed an FIR with the local police regarding the loss. I have a certified copy of registry with me. Property in under my name in municipality.I now wish to sell this property, but I understand that banks require proper documentation to process a home loan for the buyer. Please advice.

Advocate Dhanur Singh Chauhan answered
1. Legal Ownership of PropertyEven though you have a will, banks and buyers usually expect:Legal transfer of ownership, not just a willClear title in your name➤ So, was a mutation or succession process completed based on the will?If not, you need to get legal title transferred in your name by:Probating the will (mandatory in some states like Maharashtra, West Bengal, Delhi if the will relates to immovable property in urban areas)OR through succession certificate (if there's no probate and no contest from family)> ⚠️ Unregistered wills are valid, but probate adds legal enforceability and is often required by banks and buyers.---
