Q: Sister wants mother's property

Sister is getting retired soon & to reap some monetary benefits from office, she has to own a property. She asked my mother to transfer her flat as gift. She said she will sell back after few months to mother. My mother has a will where her flat will be transferred to both me and my sister. She said she will sign any legal paper to safeguard my interest. Please advise if transferring property in my sister's name is in my interest.

Advocate Avinash Singh answered
Your mother must not transfer property as a gift to your sister if you're not in good terms with your sister. If your mother transfers property in your sister's name, the will shall not be applicable. You can take a PDC from your sister in case she's willing to sell property in the near future. This way, your financial interests shall be secured. You can consult me for further strategy counseling.
