Questions Answered by Advocate Apoorv Srivastava
Q: WHat step can be taken if husband not taking to his home
I married to my bf in court and temple he said he will marry me in hall in presence of all relatives then he will take me his home from 3 months i am at my parents home and he is extending dates but not taking me at his home . What should I do?
Advocate Apoorv Srivastava answered
Hi,As you mentioned that you two were married in Court, there has to be a marriage certificate to show that you are legally married to your husband. I need you to show me the certificate. If in case you don't have a certificate then any other document to show proof of marriage.Remedy in case you have the Certificate : Can prefer an Application for Restitution of Conjugal Rights. Which will help you to get your husband back.
Q: Legal action against business partner for fraud
What is the legal action to take when a sole proprietor my business partner has conspired with his family and few worker to get me out of business and take it over.was also forcibly removed from office ...all machinery and files under their control. AFTER NC WAS FILED.STILL DID NOT obey officers instruction and threw me out.not giving access to my files..material and any documents . Accountant was threatened and told to leave.
Advocate Apoorv Srivastava answered
As you mentioned that you have already filed NC with the concerned Police Station and then also your partner is not willing to run the business peacefully in that case you can prefer filing an FIR with the Police Station (Most importantly you will have to show that the offences are cognizable in nature). If officers at the Police Station deny to register your FIR then file a written Complaint addressing the Sr. Inspector of Police Station of the concerned police station. Last resort for you to get the FIR registered is filing of Complaint before a Magistrate u/s. 156(3) of the Cr.P.C. for direction to Police to register the FIR.
Q: How to quash an FIR filed by my girlfriend
My girlfriend lodged a criminal complaint having sexual relationship on the basis of false promise of marriage in October 2017 and we had love affair for almost 3 months before she lodged the complaint and I got anticipatory bail in November 2017 and she tried to contact me through social media and said I really apologize for whatever happened and I want withdraw the complaint and we both will get married but I didn't gave her any commitment for same and from January 2018 till date we are in love affair with each other and till now chargesheet hasn't come. We both had planned for quashing of FIR so please guide how I can go forward for quashing and does it gives positive outcome or should I go for discharge application..Which will be good for me..I am little bit confused whether to go for quashing of FIR or discharge application..
Advocate Apoorv Srivastava answered
As you mentioned chargesheet hasn’t been filed yet therefore the option of going for discharge is not there for you. Quashing is the best remedy as of now but you’ll have to be specific as to why your girlfriend/Complainant wants to quash the FIR. High Court might impose some fine on your girlfriend/Complainant for registering false FIR. Just mention in you quashing application that it all happened in the fit of anger so and so forth. Discharge Application can only be preferred after filing of Chargesheet and in cases under Sec. 376 it very unlikely to get discharged. Therefore I advise you to go for quashing ASAP.
Q: Does Court Give Acknowledgement For Original Documents Submitted
Sir , I have filed case under sec 138 & my case is on hearing stage . I have been asked to submit all original documents and cheque in the court. As I know little about the court procedure I wanted to know that does court give acknowledgement for the submitted documents & cheque ? because I fear that if any document or cheque is misplaced or lost in the court then what to do ?
Advocate Apoorv Srivastava answered
As you said that you matter is on the stage of hearing that means you have furnish your original documents by the way of Affidavit of Evidence. Courts don’t give any acknowledgement per se but don’t worry about your documents as they are the part of Evidence they will be kept with precaution therefore I advise you to furnish your documents before the concerned Court because that is the only way you will served with justice.PS: Don’t forget to keep 2-4 copies of original documents with you.
