Questions Answered by Advocate Ansul Bhuta
Q: Adverse possession of property after 14 years
Query:I’ve been living in my aunt’s flat since 2010 (14 years) with proof like society charges paid (2011–2015), voter ID/gas connection registered here, and voting from this address since 2012. There’s no tenancy agreement. Now, my aunt and society want to evict me, citing my unmarried bachelor status. Can I claim possession under the Limitation Act/adverse possession? Is this discrimination? My possession was open, comtinuous and notorious (known by everyone around).
Advocate Ansul Bhuta answered
What all documents do you have to prove the Adverse possession. Further was the any understanding or writing between you and your aunt in respect of the said possession. Has she given you any notice till date. You can surely take legal steps subject to evidence. The unmarried status does not affect your right. Society cannot interfere with the said right. What do u mean by notorious? Please share the documents with us so we can go through the same and provide better advise and visit us for a detailed discussion with respect to the said matter.
