Q: Arms licence for defence personnel

Sir I am serving in the Army and I am about to retire this year. I wanted to know the procedure to apply for arms licence for defence personnel in Mumbai for resettlement as an armed guard. Also is it possible to transfer an existing license and rifle of one of my fellow serviceman in my name as he does not require the same.

Advocate Ankush Subodh Pal answered
sir there are several different types of arms as your are aware. Arms are classified into types and we require to know the purpose for which a person is applying for the licences. after retirement your status will change from serving army officers to retiree therefore the class of weapons that you may or may not apply for licenses also changes. I will require to make enquiries which will involve documentation. if you wish I can do this for you. however i will require you to meet me.

Q: Can Ex wife's children of my husband claim on properties now?

My husband is Muslim and married under special marriage act with his Ex wife (Hindu). They got divorced and have 3 kids. He's paying heavy maintenance monthly , education and health expenses and have transferred properties to her as well as settlement process. His Ex-wife is well earning lady. Her monthly income (salary + additional income) would be almost 60% of my husband's salary. We got married under special marriage act recently as i am Hindu too.My questions are-1. Can she or her kids claim on my husband's existing properties as well as future properties.2. In future, how can we reduce the monthly maintenance as one kid is going to college now and they expenses are separately borne by him and very soon other will start going to hotel and college and her expenses will be paid by him only. The clarity in answers will help me to appoint my legal family advisor.Regards

Advocate Ankush Subodh Pal answered
Dear Madam,In matters of divorce and maintenance the amount is decided on the basis of the income, expenses and life style of the parties. The order of maintenance is granted to the children in case where the child is a girl it the marriage of the girl and in case of the boy till the age of majority. As far as the divorced wife is concerned the maintenance is for her on the basis of the earning capacity and dependence. To reduce the maintenance the court must consider all factors including the salary of the husband. We recommend that you book an appointment and visit us for details and discuss the matter.
