Questions Answered by Advocate Anjali Dubey

Q: Section 25 PSS Act notice – govt employee

Govt employee in Maharashtra. NBFC app loan e-NACH EMIs bounced; lenders sent Section 25 PSS Act notices (15 days). 1) If I pay only the bounced EMI within 15 days, am I safe from a criminal complaint even if the full loan is recalled? 2) If a complaint is filed in another state, can I get exemption from personal appearance? 3) How can a conviction affect my govt job? 4) How to respond to online arbitration notice?

Advocate Anjali Dubey answered
I've had one client who were facing same situation in Thane district, firstly it is a must for borrower to read the sanction letter and term sheet before signing it with NBFC and yes you can get a personal appearance exemption on the first date, you must get a local lawyer and instruct him to file exemption application for accused, court usually allow that and you try to clear the installments in meanwhile to avoid further complications

Q: Illegal possession of Pagdi room

We’re 4 siblings and our father had bought a room in a chawl on Pagdi system 40 years ago. Our elder brother illegally transferred room on his name without informing other siblings about 35 years ago. Our father was totally illiterate and blindly signed the transfer papers. Father was bed ridden and critically ill. How can we prove that elder brother cheated our father and other siblings ?

Advocate Anjali Dubey answered
I've dealt with this one case where the farmers were given their POA to one local agent, but later claimed that they were not aware of the contents, with forensic evidence the court held the document forge, same way your documents would need to be studied before giving any bluff advices
