Selling, dealing, manufacturing, or keeping on display for sale and packaging, trade dress or product infringing the Trade mark of any Proprietor is an offence and you can be sued by the proprietor of the registered TM. Any reproduction or second copy sale is legal only with due permission of the TM Proprietor.



Q: Information About File New NCLT Case

My payment from one party is due from March 2019. In December, through a lawyer, I gave a notice to the party regarding my payment. After receiving the notice, there was an agreement between the party and me and he made half the payment immediately and gave a check for the remaining amount. I have just kept the check which I have not put in the bank. But now that party is neither talking to me nor paying. Can I now file a case on that party in NCLT. Please Reply Me. Thanks

Need complete details such as name and type of the party, amount due not exact then atleast tentitive figure to decide and comment on the question. in the given details I can only suggest that NCLT is a company law tribunal and cases pertaining to recovery can be filed only against registered comanies with RoC here under insolvency laws. Further there are requirement to fulfil other conditions prescribed under the Rules. if you have a cheque with you I suggest prefer 138 NI Act suit against the defaulter.



Q: Bail Directly From Police.......

What is the procedure to get bail from police without going to court? What is the practical procedure for the same?

Complete details are required such as section you are charged with. Details of offence you have been accursed of. State and City details etc are required. in standard condition and procedure there is no possibility of bail from police as they have no authority. if you are arrested file BA if you have apprehension of arrest file ABA before competent court.



Q: Mutual Divorce during lockdown in Mumbai

We want to go for mutual divorce so what is procedure and can we file during lockdown also is seating for "martial consultation" session is mandatory

Yes Cooling down period is mandatory. Filing of F petition for mutual consent divorce is possible during this period. The procedure is to draft a petition and counselling will start. you have to go thru counselling sessions and the Counsellors report will be filed after that you will get divorce. later the copy of order will be provided to you. The entire procedure will take 6 months to a year assuming there is No issue born of wedlock and the marriage is more than a year old. We need documents from both of you such as Address and identity proof marriage photographs marriage certificate invitation card etc. and passport size photographs of both parties.



Q: File complaint against person who sent sexual abusive message online

Friend sent Sexual abusive message on instagram,messenger.All msgs screenshot sent by his wife on my husband's what's app no.I was in contact with him after married from my husband's whats app.This led to have divorce between us. I warned himmany times.He created fake id on Fb with girl name that he reach to husband fb.I blocked him. he sent 4 to 5 mail with fakeemail address on my husband's email address.That time also I warned him.I haven't revealed was scared of dissolvingmarriage. with fake Id on Fb he tried to get in touch with me.I thought there might be girl. After that he sent a message with that fake id to me at that time I came to know.Through his reference he dropped me to interview location.Both went for movie in theatre.he cliked photos that's is also being sent.Now Husband is not atallready to support me.EvenHe'll not submit his phone for verification.I don't have any prove to show in-laws& theirview is I have xtramaritalaffair.How shuld I proceed towards complaint.
