Q: Kidnapped my child passively to demand for mutual divorce

My mother in law has helped us taking care of baby but she is not torturing me and my father to get ready for mutual divorce and then take baby back. Husband's body language days he wants to live with me. Even his father is ready to get convinced, however my mother in law is passively troubling everyone and not letting me meet my husband or baby. We interveined with mahila ayog as well but she is getting adamant. We don't want to go ahead with any legal procedure to harm the relationship

There is no need to involve Mahila Mandal or people you dont know... involve your close relatives (from both sides) sit all together and talk it out. There is always a solution. The involved relatives should be fair towards both the sides... not baises to you or him...just keep that in mind. Just talk it out, all will be well.

Police is not bound to take every complaint they receive. Depending on the complaint they try to resolve the matter amicably between the parties. Now I don't know what type of complaint you are referring to... had you mentioned it, accordingly a way could have been found. However, if you feel the offense or the incident is very serious for which you want to complain and if the police is not taking the complain then you can directly go to the Superintendent of Police and explain him your situation...even if he is not taking you complaint then you can directly approach the Magistrate (any criminal court) in your city/area and file the complaint in front of the Magistrate.

Q: return of property - reduce bank guarantee

three years before in murder case applicant gold seized at police station. under return of property got order to release but to furnish ten lac bank guarantee. ... advocate didnt appeal order for revision at session court ..now normal application filed at session court where already trial is going on and judge asking under what provision he can pass the order??? please help with section

Try section 451 of CrPC.. if you are treating your application as a fresh application in a sessions court where your current case is going.if you are treating the application as a challenge to earlier Magistrate's order then file under section 397 (Revision) CrPC.

Q: Divorce case, Army authorities harassment

In Hindu marriage divorce proceeding husband file a divorce case against wife in August 2020. And she filed application for interim maintenance under section 24 dated February 2021 but intentionally delayed for submission the written statement and taken adjournment. But she is not submitted her written statement in divorce case but simultaneously she filed a cases against husband and her relatives, parents (498a, CrPC 125, Domestic violance Act ) and also she complaints against husband at duty

Biggest question is... What is your lawyer doing? or is it that you are appearing Party-in-person? Why haven't you moved application for no WS? meaning proceed the matter without the written statement of the respondent. the max time limit is 120 days...courts are generally lenient on this...but 5 years (counting from 2020) is big! Also file another application informing the court to record these adjournments are being misused.Get hold of a good lawyer, else the case will keep on lingering for many more years.
