How to enforce inheritance to father's property

25-May-2023 (In Wills / Trusts Law)
Hi, I am  a permanent resident of Odisha but currently residing in Karnataka (bangalore). My father passed away this month and he does not have a will. we (mom, sis and me) want to apply together for the legal successor for his property. He has some bank accounts and immobile property like land and house in his name which we want to transfer. I am confused on whether to apply succession or legal heir certificate for the same. Kindly advice and the procedure to follow

You can apply for either of them. You can apply for legal heir certificate in the tehsildar's office and if the same is not obtained by you then you can file an application for obtaining succession certificate in the competent civil court.

Make an application to the revenue authorities to change the khatha etc in your or your mother's name. Approach the Bank officer and ask him what he needs to release the amount standing in the name of your father. Thereafter approach the Advocate who practice civil law. Good Luck.

If the properties are all located in Odisha, it is recommended to obtain a Succession Certificate from the district/ civil court there. If the properties are in Bangalore, then you can apply for it here. Once you receive this certificate, you can initiate proceedings for effecting the transfer.
