Right of a grandson to ancestral property when father died

 I would like to ask this question and it would be very kind of you if I get an answer to this. I live in New Delhi and want to know that if in an ancestral property grandson has a right of share and how much share he can get if his father has died, mother has done a second marriage and grandfather is still alive. Father also has one younger brother and five sisters.

Hi,
If the property is ancestral then only after death of your grandfather , you shall be legal owner in respect to your share.
Both male and females have equal share.

The property on your part can be acquired as being a legal heir therefore you can go ahead and seek your relief on part of your father as his share subsequently comes to you if equally divided among all legal heirs.Secondly since your father already has younger brother and five sisters which makes your share as 1/7 th out of total property that would be acquired by all legal heirs after death of your grandfather.But this only applies in the case of inheritance intestate and not in the case of testamentary succession.Since your grand father is still alive he may dispose the property as per his will if its a self acquired property of his.Therefore there are lot of technical clinches attached to the same therefore please feel free to contact for further detailed discussion thanks.
