Mentally harassment by Brother in law & sister in law. what can I do

30-Nov-2023 (In Property Law)

My sister is 41 year old women, having 7 year old girl child, her husband passed away 3 years back and he was the only bread winner of her family, right after his death she came to know that she has heart problem also. She is in the great trouble, totally dependent on her father, who is 60 year old now. Her brother in law and sister in law are harassing her to vacate house, which approx cost is 25 to 30 Lac (approx area is 33 yard). she has been residing in that house for last 10-12 years and she has equal right in the property. What action she can take against them?

She can file the complaint to the Police and for property she can file the case in the civil court. If police is denying to register the complaint then you can file an application under section 200 of CRPC before the court.

Hi
If your husband was co owner of the house I.e owned 1/2 share after his death you and your daughter will inherit it in equal shares.
You may move civil court for partition of property and restrain order against your harassment and likely forced dispossession

She can file civil suit for partition of property. She can file FIR for harassment. She can file under DV Act also. She must do at earliest. More details like property in question is in whose name will help.
