Father dies intestate how will the property share be divided.

09-Dec-2023 (In Property Law)
I belong to Hindu background family. My father died without any will. We are 2 brothers, 2 sisters and my mother. I wanted to know that how will the property be divided , as my mother says the whole property would belong to her as she is alive. But according to my knowledge even I have a share to ask. Please help me out with this division of property also can I claim my share in this property even when my mother is alive?

In this situation, you can file heirship application in civil court so that the civil court will order that the said property belongs to you and other legal heirs. There will be 5 shares of the property. For further info contact me...

Dear Sir/Madam,

In your case property will be distribute equally among all of you.
If your family members not ready to give you share then you may file civil partition suit for claim your share in property.

if your father has not executed a will. the property belongs to all the legal heirs and not alone to your mother. all the legal heirs have equal rights in the said property. you can settle it by amicable settlement and approach us for the same
