Stay on Dismissal for services of government servent

Government employee is dismissed from services based on court case judgment of lower court (verdict -guilty) , Verdict is challenged in District court now same case is reopened and still judgment is pending in District court case is under trial. Can we apply for stay on dismissal from services untill case is under trial?

In case of conviction in a criminal case services of an employee are terminated without any departmental enquiry. If the employee is acquitted by the appellate court, the employee deserves to be reinstated. You may not succeed to get injunction against such termination.

Yes you can apply for the stay on previous judgement on behalf of current case pending kindly clarify your case which type of case it is so that it may be easy to get clarify first file a case for stay
