Can we do an "Out of court settlement" for a 4 years ongoing case in the labour court ?

There is no restriction is making Out of Court Settlement. However make sure that you agree to the terms of settlement after consulting your lawyer and taking appropriate legal advise. Once your case is compromised and settlement award is passed, then you cannot back out and such terms will be binding on you. Also, once case is compromised it cannot be re-opened

Yes. You may settle the labour matter out of court and it is legal and under subsection 2 P of the Industrial Disputes Act. In the case of Workmen Compensation There are no any provision of settlement outside the court. and not allowed outside the court.
