Can SBI preclude my right and due pension

In S.Shanmugavel vs SBI WA.1483/2014, Madras HC Bench Gave verdict dated 16.2.2015 that Pensionable service should be calculated from Date of Initial Appointment and not from date of Confirmation. SBI filed an Appeal throgh SLP.16478/2015, but SC dismissed the Appeal stating "On the facts of the Case, We are not inclined to interfere with the impugned Orders of Court. The SLP is dismissed. However, the question of Law raised is left open". I am a similarly placed Employee demanded Pension from SBI, citing the above case. But, SBI rejected stating the decision of SC that the Judgement applicable to Question of Law is kept open. Please clarify, that SBI can not preclude my right and due Pension, and advise me how I can counter this argument and get my Pension.
