How can I claim recovery Insurance company ?

2 years ago my brother purchase a second hand bike and evening time i m going with my brother bike and my friend to meet with other friends and then i m back to home my friend drive and i am siting back seat of bike then me and my met with accident at main road my brother bike hit with 50-55 years old uncle and his dead in hospital after 1 day and my friend 19 years old no he have licence insurance company said give claim 22 lakh of dead person family but company recover 50-50% claim to bike owner and my friend so that family are not afford 11 lakh so what can i do next and what happen in tgis case
In the given situation the owner of the bike and the one who was riding the bike will be held liable for compensation and in case he is not able to pay the compensation then, the said friend will be awarded imprisonment.
