Cash spent by RC owner for medical expenses of an injured

Motor vehicle (private Car) having insurance met with accident. One pedestrian got injured, admitted in hospital for five days then died. RC owner spent Rs. one lakh for his medical expenses and demanded its reimbursement from insurance company, but not yet paid. Later legal heir of the deceased filed claim petition before Tribunal. RC owner filed his counter stating all the above details. Whether the RC owner eligible for reimbursement from insurance company. If so what is procedure. Should he file separate petition before tribunal or can he get his claim through the present petition filed by the legal heir of the victim. Plz advice.

In the given situation as the insurance company was not having any contract with the RC owner, however, you can claim the same from the legal heir of the deceased as a quasi contract has been created between the legal heir and you. For that you will have to claim your reimbursement from the legal heir.
