Wife not willing to divorce. Procedure for contested divorce.

My wife and I have been living separately since Jan 2016 at the same house and from Oct 2016 Separately in different cities. I like someone who is a foreigner and want to move with her as a accompanying family member in her country however no plans to get married. While I apply for the visa will it be a problem considering my wife name is still appearing on my passport? I am planning to move to Denmark.

Hi.
If you want to remove your name in passport , only one option is there,
You should sumbit divorce papers in the passport office.
So apply divorce as soon as possible.

She will be ur legally wedded wife until you get a divorce through the cour of law. In case if u committed to the second marital life then ur first wife can file a Bigamy case against you. Until u get a divorce decree by mutual or contested through the court, your first wife name will reflect in your passport.

There are many legal grounds for divorce, like adultery, cruelty, desertion, etc. . Your case does not seem to fall into any of these. If you could give a concrete reason for seeking divorce, something can be done.

Your details are not clear. However nothing can be done to include the other person as your wife in the passport. If your spouse name is already mentioned in the passport, the same can be removed only after you obtain Court order to that effect. Therefore make up your mind before you travel to Denmark.
