What is the procedure and expenditure involved to file for a divorce

I have been married for 13 years.I have been living away from my husband for the past three years.Though I do want to file for a divorce due to mental harassment, my husband is not agreeing.We have an eleven year old son.I need to know the procedure for getting a divorce and what is the expenditure involved.I am working and though I can financially support my self,I require my husbands help for securing the future of my son.Please advice.

If both you and your husband are wiling to apply for divorce then it is very simple. Both of you can agree for all the terms of settlement and then jointly file for Divorce. The Divorce will be granted after 6 months. In the petition you can mutually agree for the custody of son and about his future etc. But if your husband is not willing to give you divorce then you must file for divorce on the ground of mental cruelty etc. Your husband may object to the divorce but after several hearings and mediation the matter can be sorted out. At that time both of you can decided about the custody & future of your son. If still your husband is adamant then you can file for maintenance of your son. You can also file for appropriate maintenance under the Domestic Violence Act. For Divorce the fees will be minimum Rs.20,000/- or more, which can be paid in installments. For other proceedings if necessary it will Rs.10,000/- or more. Anyway the fees can be negotiated after discussing the entire case. Kindly contact me for detailed discussion and clear advice.

Madam, in the interest of your son's future, you are adviced to consider your decision. I'm not aware of facts. However, you can file the divorce petition before your area jurisdictional family court under desertion. You are eligible to file after desertion of two years. For further contact me.

Yes, you can file the divorce petition on the ground of mental cruelty. Before that you have to issue a legal notice seeking his consent to divorce. While the proceedings of divorce case is pending , you can seek maintenance from your husband for your child's education and other expenses.Fees is depends upon the advocate who you are engaging,, I usually charging Rs. 40k for the entire proceedings.
