Across the table you can negotiate since it is out of court settlement. How much they are demanding? What is your property value? Kid is boy or girl? Even though it is expensive, go for out of court settlement. It will give quick solution and peace of mind.

Dear Client,
It is always better to go for court settlement. Even after settlement out side court, your wife may again file maintenance case. If it is settled in Lok Adalat your wife will not claim maintenance again. Take expert legal advise. Don`t pay anything out side court.

Hi
There is no fixed formula for grant of compensation to the wife or the son.
However court's in general consider anywhere between 25 to 30% of a person's net annual income as maintenance (for both wife and son) and if it is a case of alimony to the wife, the courts grant alimony in the range of about 6 months to 18months of net monthly salary of the person depending on individual life style and circumstances.
