Procedure to file a divorce

Hi, I want to divorce my husband. He says lot of bad words for me and my family. I feel mentally harrased. in the past he has physically abused me three times but I didn't reported any incidence to police. He is not ready for mutual divorce. We don't have any sexual relations from last two years. I have a small child. Please let me know how can I intiate filing divorce without lawyer. And what all things I can take alone with me at the time of moving out from his house.

Go to family court of your district. Make an application for divorce on the ground of cruelty. But it is better you must engaged a lawyer.

yes for divorce u can file petition on the ground of mutual as well on the ground of cruelty and for that one year time.for separation.is required u can file a petition on the ground.of cruelty before session court and after recording evidence court will pronounce order

If you to dissolve marriage , you must have engage a lawyer for this purpose. You are not seeking divorce by mutual consent. It means you have to fight a case against your husband. There are some legal aspects which need to be addressed by the lawyer. If you want to file a case without a lawyer , you can file a petition before the court of competent jurisdiction. If the judge is satisfied with your arguments, he will issue notice to your husband and the time will be given to your husband to file reply of your petition. After the arguments from the both sides, the judge may proceed for first motion divorce and if he is not satisfied with your arguments, he will dismissed your petition. You can also claim maintenance but for this also you have to file a suit for maintenance. In short, without lawyer you can approach the court and file a case. But for better and effective hearing, you should engage a lawyer. Rest is your discretion. Revert me your any other query. All the best.

It is all depend upon the circumstances of each case ,in your case if you have already decided to part your ways then first try to collect and take your jewellery articles and other articles with you before disclosing this fact to other party and if it does not work then you can file divorce petition before family court.
and it is always advisable to go for mutual consent
