need divorce from my wife but she is not willing to give

we are staying separate for 3 years and paying maintenance every month, before separation kept all assets with her, still she is not ready to give divorce. What is the legal way i can proceed so i can get it without hampering our daily life. i am begoli but she is tamilian.

I suggest you to first issued a legal notice through your advocate asking her to agree for a mutual divorce. if she refuses for the same, then i suggest you to file a contesting divorce petition before the jurisdictional family court.

Yes u can file a petition for divorce on ground of desertion and cruelty and if you prove it you can get the divorce legally. As already you are paying maintenance you can file divorce there is no harm.
