If your wife also wants to divorce then it would be easy to divorce under sec.13(B) of Hindu marriage act. But if your wife do not co-operate then you have to file a case under sec.13(1) of H.M.Act by any fault ground before The Ld.
session's Court.

Dear Client,

You can apply for mutual divorce which will take less time and money. Talk to her and if she agrees for mutual divorce then file it through a lawyer. Else you have to file a divorce petition for contested divorce. If you want to get the custody of the child then you can file a case for custody.

Yes you can file Mutual Divorce by jointly if both the party are agreed for Divorce. Or you may file Divorce Petition against your Wife on the ground of Desertion, which can be file if both the party resides separately since 2 years without interruption. ,
